Terms of Service
These Terms are an agreement between you and PrimeEdge Solutions LLC ("we", "us") for using the PromptPearl AI app and website ("PromptPearl"). By creating an account you accept these Terms, our Privacy Policy, our Content Policy and our Subscription & Refund terms.
1. Who can use PromptPearl
You must be at least 18 years old and able to make a binding agreement. One person per account; keep your password private. You are responsible for activity on your account.
2. What PromptPearl does
PromptPearl uses third-party artificial intelligence services to make pictures, videos, photo edits, voices, music, stories and social media text from your instructions. Results are generated automatically, can be inaccurate or unexpected, and may look similar to results made for other people. Features and AI models may change, improve or be replaced over time.
3. Credits
- Paid features use credits. The cost of each action is shown in the app before you start it (for example: picture 1 credit, HD picture 4, 5-second video 7).
- Credits from a monthly plan are refreshed at each renewal; unused plan credits end with the month. Credits from packs and welcome credits do not expire while your account is open.
- If a creation fails, the credits it reserved are returned automatically.
- Credits have no cash value, cannot be transferred or sold, and end when your account is deleted.
- We may change credit prices for future actions; we will show the new prices in the app before they apply.
4. Your content
You keep whatever rights you have in the prompts and photos you provide ("your input"). Subject to these Terms and the rights of others, we assign to you any rights we have in the outputs made for you. You give us permission to store, process and send your input and outputs to our service providers only to run PromptPearl for you, to keep it safe, and as described in the Privacy Policy.
You confirm you have the rights and permissions needed for anything you upload, including photos of other people, and that your use of outputs follows the law. Because AI outputs may not be eligible for copyright protection and may resemble existing works, you are responsible for checking an output before using it commercially.
5. Acceptable use
You must follow the Content Policy. You must not misuse PromptPearl, try to get around safety systems or limits, access other users' data, reverse engineer or overload the service, resell access, or use it to break any law. We may block content, limit features, or suspend or close accounts that break these rules, and report illegal content to the authorities.
6. Reports and copyright
Use the flag button on any creation or email promptpearl.support@gmail.com to report content. Copyright owners can send notices with: the work, the content at issue, contact details, and a statement of good-faith belief and accuracy under penalty of perjury.
7. Purchases
Plans and credit packs are bought through Google Play or the Apple App Store and are also governed by their terms. See Subscriptions & Refunds.
8. Disclaimers
PromptPearl is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including that results will be accurate, unique, uninterrupted or fit for a particular purpose.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places do not allow these limits, so they may not apply to you.
10. Indemnity
You agree to cover our reasonable costs from claims caused by your input, your use of outputs, or your breaking these Terms.
11. Ending your account
You can delete your account at any time in the app. We may suspend or close accounts that break these Terms. Sections that by their nature should survive (such as 4, 8, 9, 10 and 12) continue after closing.
12. Law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Virginia, unless the law where you live gives you the right to bring a claim locally.
13. Changes
We may update these Terms. We will post the new version here with a new effective date and tell you in the app about significant changes. Continuing to use PromptPearl after that means you accept them.
